By accessing or using BasinCheck, you agree to be bound by these Terms of Service. If you do not agree, you may not use our services.

2. Description of Service

BasinCheck provides a cloud-based platform for managing safety audits, tracking corrective actions, documenting workplace incidents, and generating OSHA compliance reports.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to your account.

4. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with other users' use of the service
  • Upload malicious code or content
  • Violate any applicable laws or regulations

5. Data Ownership

You retain ownership of all data you upload to BasinCheck. We claim no intellectual property rights over your content. However, you grant us a license to host, store, and display your content as necessary to provide our services.

6. Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. All payments are non-refundable except as required by law. You may cancel your subscription at any time, and access will continue until the end of your billing period.

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability. We will provide notice when possible for planned maintenance.

8. Limitation of Liability

BasinCheck is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid for the service in the past 12 months.

9. Indemnification

You agree to indemnify and hold harmless BasinCheck from any claims arising from your use of the service or violation of these terms.

10. Modifications

We may modify these terms at any time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance of the modified terms.

11. Termination

We may terminate or suspend your account for violation of these terms. Upon termination, you may request export of your data within 30 days.
